Terms of Service

These Terms of Service ("Terms") govern your access to and use of GoWellness ("we", "us", "our"), including the website at gowellness.io and the affiliate platform (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

• You must be at least 18 years old.
• You must have the legal capacity to enter into a binding contract in your jurisdiction.
• You must not be located in, under the control of, or a national or resident of any country or party subject to applicable Canadian sanctions or trade restrictions.
• If applying as an entity, you represent that you have authority to bind that entity.

2. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or applicable law.

3. Our role: introductions only

GoWellness is an introduction platform, not an affiliate network. We curate brand partners (currently TriVita), help you discover offers, and direct you to the partner's own affiliate program. Once you enroll with the partner, your affiliate relationship — including tracking, commission rates, cookie windows, fraud handling, and all payments — is governed by that partner's terms, not ours.

GoWellness does not pay commissions. All commissions, residuals, bonuses, and any other compensation are paid solely by the brand partner directly to you, on the partner's schedule and through the partner's chosen payment method. GoWellness is not a party to that payment relationship and assumes no obligation to compensate you under any circumstance.

Any commission rates, cookie durations, or payout terms displayed on the GoWellness Service are informational summaries of the partner's published terms at the time of display and are subject to change by the partner without notice. The partner's own terms always control.

Disputes about a specific commission, payout, refund, chargeback, order fulfillment, product quality, or anything else related to a sale are between you and the brand partner. We may, at our discretion, help facilitate communication, but we are not responsible for resolving them.

4. Promotional rules

You agree to promote TriVita products lawfully, honestly, and in compliance with all applicable advertising regulations including the FTC Endorsement Guides. Specifically, you must not:

• Make unapproved health, medical, or therapeutic claims about TriVita products.
• Imply FDA approval, clinical guarantees, or outcomes that the product label does not support.
• Run paid search ads on trademarked TriVita or GoWellness terms without written approval.
• Send unsolicited email, SMS, or messaging spam (you must comply with CAN-SPAM, TCPA, GDPR/UK GDPR e-marketing rules).
• Self-purchase, click-fraud, or use bots, traffic-injection, or cookie-stuffing schemes.
• Promote on sites that contain illegal, infringing, hateful, sexually explicit, or otherwise prohibited content.
• Misrepresent yourself, your audience, or your affiliation with GoWellness or TriVita.

5. Intellectual property

GoWellness and TriVita retain all rights, title, and interest in their respective trademarks, logos, content, and creative assets. We grant you a limited, revocable, non-exclusive, non-transferable license to use the creative materials we provide solely to promote approved offers under these Terms. You may not modify logos, alter product images, or use our marks in a way that implies endorsement beyond the affiliate relationship.

6. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your GoWellness account immediately if you violate these Terms, engage in fraud, or harm the GoWellness or partner brand. Termination of your GoWellness account does not affect any independent affiliate relationship you have with a brand partner — that relationship continues to be governed by the partner's terms. Any unpaid commissions are owed to you (or not) by the partner according to the partner's policies, and GoWellness has no role in that determination.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee any specific level of earnings, traffic, or conversion. Affiliate income depends on your effort, audience, and market conditions.

8. Limitation of liability

To the maximum extent permitted by law, GoWellness and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, commissions, or anticipated earnings, whether incurred directly or indirectly. Because GoWellness does not collect fees from affiliates and does not pay commissions, our total aggregate liability for any claim arising out of these Terms or the Service is capped at CAD $100.

9. Indemnification

You agree to indemnify and hold harmless GoWellness, TriVita, and our respective officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your promotional content, or your breach of these Terms.

10. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. The courts of British Columbia, sitting in Vancouver, will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

11. Changes to these Terms

We may modify these Terms from time to time. Material changes will be announced by email or in-app notice. Continued use of the Service after the effective date of revised Terms constitutes acceptance.
